Governing terms for the MLPipeline Cloud platform

These Terms of Service ("Terms") govern your access to and use of the MLPipeline Cloud platform, website, APIs, CLI tools, and related services (collectively, the "Service") provided by MLPipeline Cloud B.V. ("MLPipeline Cloud", "we", "us"), a company registered in Amsterdam, the Netherlands. By accessing or using the Service, you agree to be bound by these Terms.
To access the Service, you must create an account by providing accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@mlpipeline-cloud.com if you suspect unauthorized access to your account.
The Service is provided for the purpose of building, deploying, and managing machine learning pipelines and related workflows. You may use the Service in accordance with these Terms and the applicable plan limits described on our pricing page. You agree not to:
You retain all ownership rights in the data, code, model weights, pipeline definitions, and other content you upload to or create using the Service ("Your Content"). We do not claim any ownership interest in Your Content. We access Your Content only as necessary to provide, maintain, and improve the Service, and as described in our Privacy Policy.
You grant us a limited, non-exclusive license to host, store, process, and transmit Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.
We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance (which we will announce in advance when possible), infrastructure incidents, or circumstances beyond our reasonable control. Enterprise plans include specific Service Level Agreements with uptime commitments and remedies.
Paid plans are billed in advance on a monthly or annual basis. Compute usage (CPU-hours and GPU-hours) that exceeds your plan allowance is billed at the overage rates published on our pricing page. Payments are processed in Euros (EUR) or US Dollars (USD) as selected during registration. All fees are exclusive of applicable taxes, which will be added where required by law.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except as required by applicable consumer protection law.
Our processing of personal data is governed by our Privacy Policy. For customers who require a Data Processing Agreement (DPA) under the GDPR, a standard DPA is available upon request and forms part of these Terms when executed.
The Service, including its software, documentation, APIs, and branding, is owned by MLPipeline Cloud and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade names. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
To the maximum extent permitted by applicable law, MLPipeline Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total aggregate liability for any claims arising from these Terms shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
You agree to indemnify and hold harmless MLPipeline Cloud from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
Either party may terminate these Terms at any time. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if continued provision of the Service becomes impractical due to regulatory changes. Upon termination, you may export Your Content within 30 days, after which we may delete it.
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law provisions. Any disputes arising from these Terms shall be resolved in the competent courts of Amsterdam, the Netherlands, unless you are a consumer entitled to file claims in your jurisdiction of residence under mandatory consumer protection law.
We may modify these Terms from time to time. Material changes will be communicated to registered users at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
